Preventing Unjust Deportation and Family Separation 

Across the United States, immigrant community members with decades-old removal orders—many of whom are former refugees who arrived as children—are being detained without lawful authority and threatened with deportation to countries they barely know or that will not accept them. In extreme cases, ICE is deporting these individuals to third countries, often where they are unlawfully imprisoned.  

In response to the Administration’s targeting of longtime residents, SCP has transformed the Immigrant Post-Conviction Relief Program into a rapid-response, community-powered legal and organizing initiative that is designed to prevent unlawful detentions and attempted deportations. This initiative has harnessed the writ of habeas corpus as a tool to free individuals from unconstitutional imprisonment, restore their lawful immigration status, and activate communities to defend democratic principles under threat. 

In the past year, the Immigrant Post-Conviction Relief Program has freed 22 individuals from ICE custody and restored legal protections and lawful status for 32 individuals who were enduring lifelong conviction consequences.
